The following terms govern use of the Alba Sydney website, www.albasydney.com.au (the Website). By accessing or using the Website, you accept and agree to these Terms. If you do not agree, please do not use our Website.

Ownership

The Website and all content is owned and operated by Alba Sydney Pty Ltd, ABN 14 688 851 434, of 1/266 Catherine Street, Leichhardt NSW 2040, Australia.

Orders

All orders submitted through the Website are subject to acceptance by Alba Sydney. Placing an order constitutes an offer to purchase — it does not constitute acceptance.

We reserve the right to refuse or cancel any order, including but not limited to where:

  • A product is unavailable
  • A pricing or description error appears on the Website
  • Suspected fraudulent or abusive activity is identified
  • A technical error has occurred during processing

Acceptance of your order occurs when we dispatch your item(s) and send a dispatch confirmation email. A full refund will be issued if your order is cancelled for any reason.

Pricing and GST

All prices on our Website are in Australian dollars (AUD) and inclusive of GST. Prices are subject to change without notice. We are not obligated to honour pricing errors.

Availability

We make every effort to keep our inventory accurate; however, stock levels are not updated in real-time and discrepancies may occasionally occur. If we are unable to fulfil your order, we will notify you promptly and arrange a full refund where no suitable alternative is available.

Promotional codes

From time to time, Alba Sydney may offer promotional discount codes. Please refer to the specific terms of each promotion for timeframe and exclusions. Promotional codes:

  • Cannot be combined with any other offer or discount
  • Are subject to the terms stated at the time of issue
  • Cannot be applied to Final Sale items unless specifically stated

Promotional and sale periods

Alba Sydney reserves the right to commence, conclude or amend sale events without prior notice. Discounted prices are valid only during the sale period and will not be honoured once the sale has ended. Prices online may differ from those in-store, particularly during online-only promotions.

We are not obligated to refund the price difference on items purchased outside a sale period or on items that are subsequently restocked or repriced.

Right to refuse service

Alba Sydney reserves the right, at our sole discretion, to refuse service, refuse a sale, or cancel any order or transaction — whether placed online or in-store — at any time and for any lawful reason. Circumstances in which we may exercise this right include (without limitation):

  • Suspected fraudulent, abusive or unlawful activity
  • Breach of these Terms or any other Alba Sydney policy
  • Abusive, threatening or disrespectful conduct toward our staff or other customers
  • Excessive returns or apparent misuse of our returns policy
  • Pricing, description or stock availability errors
  • Where the order or transaction would breach any applicable law

This right is exercised in accordance with applicable anti-discrimination law and does not affect your rights under the Australian Consumer Law. Where we cancel an order that has already been paid for, a full refund will be issued to your original payment method.

Use of the Website

You must not use the Website:

  • For any unlawful activity or in breach of any applicable law
  • To copy, reproduce, republish, transmit or distribute any content without our written consent
  • To post obscene, threatening, defamatory or otherwise inappropriate material
  • To use any automated tools (bots, scrapers, spiders) to extract content
  • To attempt to gain unauthorised access to any part of the Website
  • To interfere with the Website's normal operation or any connected networks
  • To breach any third party's intellectual property or privacy rights

Intellectual property

All content on the Website — including text, images, graphics, logos, trademarks, software and interfaces — is owned by or licensed to Alba Sydney. You may not use, reproduce or distribute this content without our express written permission.

All brand names, product names and trademarks referenced on the Website are the property of their respective owners.

Limitation of liability

To the maximum extent permitted by law, Alba Sydney:

  • Does not warrant that the Website will be uninterrupted, error-free or free from viruses
  • Does not warrant the accuracy or completeness of information on the Website
  • Is not liable for any indirect, special or consequential loss arising from use of the Website

Nothing in these Terms limits or excludes your rights under the Australian Consumer Law, including the consumer guarantees that cannot be excluded.

Indemnity

You agree to indemnify and hold harmless Alba Sydney, its directors, employees and agents from any claim, loss, liability, cost or expense (including legal fees) arising from your use of the Website or your breach of these Terms.

Gift cards

Alba Sydney gift cards are available for purchase in-store and online.

  • Gift cards are valid for 3 years from the date of purchase, in accordance with the Treasury Laws Amendment (Gift Cards) Act 2018 (Cth)
  • Gift cards cannot be redeemed for cash
  • Lost or stolen gift cards cannot be replaced
  • Gift cards are not refundable
  • Gift cards may be used as full or partial payment for in-store and online purchases
  • No post-supply fees are charged on Alba Sydney gift cards (other than amounts permitted by law, such as fees for replacement of a damaged card)

Variation of these Terms

We may update these Terms at any time. Continued use of the Website following any update constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.

Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales.
